Federal lawsuit filed over FOID card delays

CHATSWORTH (WSIL) -- The Illinois State Rifle Association (ISRA) and the Second Amendment Foundation (SAF) have filed a lawsuit against the director of the Illinois State Police (ISP) in an effort to push the police agency to issue firearm owner identification cards within 30 days.

The two organizations filed the lawsuit Monday.

The two organizations say ISP must issue a FOID card to comply with the mandated 30-day requirement if the applicant meets all qualifications.

SAF founder and Executive Vice President Alan M. Gottlieb says ISP sometimes does not act for as long as 60 or 90 days when issuing or denying a card.

“This has been going on for years,� said Gottlieb. “And it has to stop. It is especially important now, with the surge in FOID applications as a response to recent civil unrest that has included looting and violence. Illinois residents expect efficiency, not excuses, and they haven’t been getting it.�

“These delays have gone on long enough. We had hoped to avoid litigation, but at this moment, we have no choice,� said Richard Pearson, ISRA executive director.

The lawsuit, , names ISP Director Brendan Kelly and ISP Firearms Services Bureau Chief Jessica Trame as defendants.
