DeVore plans to file amended complaint against Pritzker to address “Community Recovery Order�

LOUISVILLE (ILLINOIS CAPITOL BUREAU) -- A Clay County tanning salon owner's lawsuit case against Gov. JB Pritzker is on hold. James Mainer's attorney says he plans on filing an amended complaint against the Pritzker administration next week in order to address the governor's .

Tom DeVore says both parties called Clay County Judge Michael McHaney Friday morning to discuss the planned status hearing. They agreed there was no need to meet in person. McHaney granted Mainer a  from Pritzker's stay-at-home order during his first court appearance. However, DeVore asked to drop the restraining order last week. The initial lawsuit claims Pritzker doesn't have the authority to extend his emergency powers beyond the initial 30 days. Now, DeVore wants to tweak the language to address Pritzker's "Community Recovery Order."

The Illinois General Assembly unanimously supported two bills acknowledging Pritzker's authority to issue consecutive disaster proclamations during special session last month.  amends the state's Township Code allowing annual township meeting postponement due to disaster declarations. It also includes detailed instructions for situations where "a subsequent disaster declaration is declared under Section 7 of the [Act] prior to ... the expatriation of the disaster declaration."

 amends the Sexual Assault Survivors Emergency Treatment Act. It allows federally qualified community health centers to provide forensic services for sexual assault survivors. The plan ensures the medical resources will remain available during, and three months after, a state disaster proclamation. Pritzker signed both measures into law Friday afternoon.

The attorneys will discuss future court dates next week.
