Does Gov. Pritzker have constitutional authority to enforce restaurant restrictions?

  • 0

(WSIL) -- Many questions remain whether Illinois Governor JB Pritzker has the constitutional authority to legally enforce COVID-19 restrictions on restaurants.

The Jefferson County Chamber of Commerce held a Zoom presentation earlY Tuesday afternoon with Attorney Gregory Odom to discuss legal considerations for Illinois restaurants. Odom talked to the group about how the Disaster Proclamation relates to COVID-19 and restaurants.

One district in Illinois has cases on the book showing the governor's actions are acceptable during a pandemic. Odom also talked about the insurances available for restaurants to lessen the legal blow if they choose to stay open and an employee or customer contracts the virus in their establishment.

"I do know that it is legal, I don't know the complete details but I do know there is protection," said the owner of La Galeria Mexican Cuisine and Creamery, Laura Leal.

Most policies provide some type of coverage, but there can be limitations that business owners would have to discuss with insurance provider.
